By accessing or using Testy.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

Testy.io is a quiz builder platform that allows you to create interactive quizzes — including personality quizzes, scored assessments, and product recommenders — embed them on websites, capture leads, and integrate with email marketing platforms.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or have the legal capacity to enter into these terms.
• One person or entity may not maintain more than one account.

• New accounts receive a 14-day free trial with access to core features.
• After the trial period, you must subscribe to a paid plan to continue using the Service.
• Subscription fees are billed in advance on a monthly or annual basis through Stripe.
• All fees are non-refundable except as required by law.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Collect personal information without proper consent or legal basis
• Send spam or unsolicited communications through quiz integrations
• Create quizzes containing illegal, harmful, or misleading content
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other users' accounts or data
• Resell or redistribute the Service without authorization

• You retain ownership of all quizzes, questions, outcomes, and other content you create.
• You grant us a limited license to host, display, and distribute your content as necessary to provide the Service.
• You are responsible for the lead data you collect and must comply with applicable privacy laws (including GDPR and CAN-SPAM).
• You may export or delete your data at any time through the Service or by contacting support.

The Service, including its design, code, features, and branding, is owned by Testy.io and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

Each subscription plan includes specific limits on:

• Number of active quizzes
• Number of leads captured per month
• Available integrations and features

If you exceed your plan limits, we may ask you to upgrade. We will not delete your data without notice.

We strive to maintain high availability but do not guarantee uninterrupted access. We are not liable for any downtime, data loss, or service interruptions. Planned maintenance will be communicated in advance when possible.

• You may cancel your subscription at any time through the billing portal.
• We may suspend or terminate your account for violations of these terms.
• Upon termination, your data will be retained for 30 days before permanent deletion, unless you request earlier deletion.

To the maximum extent permitted by law, Testy.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

We may update these Terms of Service from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of applicable jurisdiction.
